PATRIOT ACT II

How just is the Justice Department? As if the Patriot Act wasn't enough to destroy our Bill of Rights, the Justice Department has now drawn up "Patriot Act II" titled the DOMESTIC ENHANCEMENT ACT OF 2003 (DSEA). Back in February the Center for Public Integrity (www.publicintegrity.org) came into possession of a copy marked "CONFIDENTIAL - NOT FOR DISTRIBUTION." This bill contains more harsh language threatening our Constitutional rights. Like the first Patriot Bill, it does little to improve our national security. It gives the government more power to bug, wiretap or search anyone in America without going to any court for a warrant or court order. It gives the government authority to seize personal information including credit, health, education and other private subjects. This can be done without approval of any court, just by issuing "administrative subpoenas," issued by some bureaucrat. This information can be used to prosecute individuals and groups, which engage in or advocate civil disobedience. American citizens can be classified as "foreign powers" and subject to electronic surveillance. This "Security Act" authorizes the creation of a DNA bank of all persons "suspected" of being terrorists.

Note the term "SUSPECTED." According to the federal government isn't everyone a SUSPECT? If not, why do they search innocent people at this airport? This bill allows citizens to be arrested and held "indefinitely" without charges, in secret locations without access to an attorney or benefit of constitutional protection. The bill also allows the government to revoke the citizenship of native-born Americans for even minor transgressions.

Of course we want to catch and prosecute the terrorists. Of course our government needs to check out all legitimate threats, but does it have to wreck our Constitution in order to do this? In December of 2002 I wrote in the Common Sense Chronicle an article titled: HOMELAND SECURITY - HOW SECURE ARE WE? and I will use the closing paragraph in that article to close this one on the Patriot Act II.

This isn't the first time a nation has cried out for HOMELAND SECURITY. In 1933 Adolph Hitler, writing about the creation of the German Gestapo wrote: " An evil exists that threatens every man, woman and child of this great nation. We must take steps to insure our domestic security and protect our Homeland."
