Never before in American history has the Executive Branch of government assumed more of the powers constitutionally vested in Congress than this one. One of the latest disputes between the Department of Justice and the House Oversight and Government Reform Committee is illustrative.
The FBI and the Department of Justice have refused to cooperate with the on-going congressional investigation of the IRS targeting of conservative tax-exempt organizations, singling them out for discriminatory treatment. On January 8, Oversight and Government Reform Committee Chairman Darrell Issa sent a critical letter to Attorney General Eric Holder, the same attorney general who carries the dubious distinction of being the only one in American history found in contempt of Congress. The letter states that the Administration’s refusal to cooperate “may rise to the level of criminal obstruction of a congressional investigation.”
In his letter, Chairman Issa explains that the Committee has been informed by current and former IRS officials that Holder’s appointee in charge of coordinating the investigation of the IRS, Barbara Bosserman, has a conflict of interest because she is a political partisan for the President.
Barbara Bosserman, a trial attorney in the Department of Justice’s Civil Rights Division, leads the DOJ/FBI investigation. As it turns out, she has a long history of financial support of the Democratic National Committee and, according to Issa’s letter, “donated nearly $7,000 to President Obama’s political campaigns and the Democratic National Committee in the past several years.”
Issa blasts DOJ for placing such a blatant partisan in charge of the investigation, explaining that under Bosserman the DOJ and FBI have utterly failed to cooperate with the Committee. Issa writes: “By selecting a significant donor to President Obama to lead an investigation into inappropriate targeting of conservative groups, the Department has created a startling conflict of interest. It is unbelievable that the Department would choose such an individual to examine the federal government’s systematic targeting and harassment of organizations opposed to the President’s policies. At the very least, Ms. Bosserman’s involvement is highly inappropriate and has compromised the Administration’s investigation of the IRS. We request that you immediately remove Ms. Bosserman from the ongoing investigation. In addition, since the aforementioned conflict or interest has tainted any information Ms. Bosserman has gathered thus far, we request that you take all necessary steps to ensure that the DOJ/FBI criminal investigation is thorough and unbiased, including steps to remedy the damage created by Ms. Bosserman’s leadership of, and participation in, the investigation.”
Issa demands by January 22 a “comprehensive explanation of the decision to assign Ms. Bosserman to the DOJ/FBI investigation” and the steps the Department will take “to remedy the damage created.”

The assignment of an Obama partisan to lead the DOJ/FBI investigation of the IRS targeting of conservative groups is but the latest of dozens of comparable scandals coming out of this Administration. Through it all, we see the stark reality that respect for the rule of law, integrity, and accountability in government have been replaced with lawlessness, base motivation, and imperial political rule. The Constitution is but parchment to this Administration, parchment it regards as disposable at will. Unless the public rises to vote the party in power out of office and replace it with those committed to restoration of the Constitution, the corruption so commonplace now will become a regular fixture of governance, leading the United States to emulate the Roman Empire on the eve of its collapse.
